What the 2026 Midterm Elections Mean for Truck Drivers

 |
November 4, 2026

The 2026 midterm elections are over, and Democrats have won control of both the House of Representatives and the Senate. That’s a major change in Washington, but what does it actually mean for truck drivers?

If you’re a truck driver, an owner-operator, or someone who owns a trucking business, the decisions made in Washington can affect how much money you earn and how much it costs to stay on the road. We’re talking about diesel prices, CDL requirements, tariffs, and even where you’re allowed to park your truck.

The big question is whether the election results will make life easier for truck drivers.

In today’s article we’ll break down the five things every truck driver should be paying attention to.

1. Diesel Prices: Will the Midterm Elections Bring Relief?

Let’s start with the big one.Diesel prices are putting serious pressure on the trucking industry.According to the U.S. Energy Information Administration, the national average price for on-highway diesel was approximately $6.29 per gallon on November 2, 2026.That’s more than $2.50 per gallon higher than the same time last year. For owner-operators and trucking companies, these prices can make a huge difference. Think about a truck that uses 150 gallons of diesel a week. If diesel costs $2 more per gallon, that’s an extra $300 every week, or roughly $1,200 over four weeks. That’s money coming directly out of the business unless the added expense can be passed on to customers.

Why is diesel so expensive?

A major reason diesel prices have increased is the conflict involving the United States and Iran. Fighting in the Middle East has disrupted oil shipments and created uncertainty in the global energy market. When oil becomes more expensive or harder to transport, diesel prices often increase as well.

Can the new Congress lower diesel prices?

Here’s where things get complicated. With Democrats controlling Congress beginning in January, lawmakers will have greater power to investigate the administration’s decisions, debate war-related funding, and propose legislation. But the president still controls important parts of foreign policy, and legislation can face a presidential veto.Even if the conflict ends or oil shipments improve, diesel prices might not immediately return to their previous levels. Refineries, inventories, and global transportation networks all need time to adjust. What this means for truck drivers: The election could lead to more pressure to change U.S. policy toward Iran, but cheaper diesel is not guaranteed. Owner-operators and trucking companies should continue watching fuel expenses closely rather than expecting an immediate price drop.

2. Non-Domiciled CDL Rules: Will the New Congress Change Who Can Drive?

Another major issue affecting the trucking industry is the federal government’s new restrictions on non-domiciled commercial driver’s licenses. In March 2026, the Federal Motor Carrier Safety Administration (FMCSA) implemented major changes to the rules for non-domiciled commercial driver’s licenses.

Who can get a non-domiciled CDL?

Under the current federal requirements, the qualifying employment-based nonimmigrant categories are:

  • H-2A temporary agricultural workers
  • H-2B temporary non-agricultural workers
  • E-2 treaty investors

These restrictions have created uncertainty for some existing drivers and people hoping to enter the trucking industry. However, that doesn’t mean everyone affected by the new rules immediately lost their CDL. The impact depends on each driver’s circumstances, the validity of their existing license, and how states apply the federal requirements.

Could Democrats Reverse These CDL Rules?

Yes, but it won’t happen overnight.

Even though Democrats won control of Congress, that doesn’t mean the CDL rules will automatically change.

Democrats could try to pass new laws to change these restrictions. But President Trump could veto those laws, making it difficult to reverse the rules.

There’s also a proposed law called Dalilah’s Law:

The proposal includes stricter requirements related to immigration status, English proficiency, and CDL testing. Supporters argue these measures would improve highway safety and licensing standards, while opponents of tighter eligibility rules are concerned about their effects on legally present workers and the trucking workforce.

With Democrats taking control of Congress in January 2027, passing the proposed law could become more difficult. However, Republicans could still try to move it forward before the new Congress takes office.

What does this mean for truck drivers?

For now, the current CDL rules remain in place. We may see changes in the future, but nothing is guaranteed. If you’re planning to get your CDL, make sure you understand the current requirements before signing up for training.

3. Tariffs: Could Trucking Costs and Freight Demand Change?

Tariffs are another major issue affecting the trucking industry. A tariff is a tax placed on certain goods imported from another country. When those imported products become more expensive, businesses may change how much they purchase, where they purchase it, and how they move it.

For trucking companies, tariffs can affect business in several ways. Imported truck parts, equipment, and materials may become more expensive, raising the cost of maintaining or purchasing trucks. Tariffs can also influence freight demand because companies may order fewer imported products or change their shipping routes.

Cross-border trucking is especially sensitive to trade policy because large amounts of freight move between the United States, Canada, and Mexico. However, the impact isn’t the same everywhere. Some freight markets have slowed, while others, including parts of the U.S.-Mexico shipping market, have continued to grow despite tariff uncertainty.

Will Democrats Remove Trump’s Tariffs?

Democrats may try to challenge some of President Trump’s tariff policies, but removing them won’t necessarily be easy. Many tariff decisions involve powers held by the president, so controlling Congress doesn’t automatically give Democrats the ability to cancel every tariff.

Congress could propose new laws, investigate how tariffs affect businesses, or try to limit certain presidential trade powers. However, Trump could veto legislation that changes his tariff policies. Overriding a presidential veto would require enough support from both parties, which could be difficult.

What this means for truck drivers: Tariffs could continue affecting freight rates, equipment prices, and the number of loads available in certain markets. Drivers and trucking companies should pay attention to the industries they serve because changes in trade policy can create opportunities in some freight markets while hurting others.

4. Could the New Congress Improve Highways and Truck Parking?

Sometimes, the biggest problems are the ones drivers face every day such as damaged highways, traffic congestion, unsafe bridges, and even finding a place to park.

Highway infrastructure is actually one of the few topics where Democrats and Republicans have been able to work together. We would not be surprised to see a number of new infrastructure projects getting passed by congress.

One issue that deserves more attention is the shortage of safe truck parking. Long-haul drivers know how frustrating it can be to finish a day of driving and struggle to find an available parking space. This can become a serious problem when drivers need to comply with hours-of-service rules but can’t find somewhere safe and legal to stop.

Could We See More Truck Parking Projects?

With a new Congress taking office in 2027, lawmakers may have another opportunity to work together on infrastructure projects. Better highways, safer bridges, and more truck parking could help drivers spend less time dealing with unnecessary delays and improve working conditions.

However, these projects won’t happen simply because Democrats won the election. Congress still needs to agree on funding, pass legislation, and allow time for approved projects to be completed.

What this means for truck drivers: Infrastructure and truck parking could be areas where the new Congress makes progress. The benefits would likely take time to reach drivers, but improvements could make a meaningful difference in their daily working lives.

5. Truck Driver Pay and Working Conditions

Another issue worth watching after the midterm elections is truck driver pay and working conditions. Trucking isn’t an easy job. With the cost of living going up, how much drivers actually take home is becoming even more important.

One issue Congress could look at is overtime pay. Under current federal law, many truck drivers are exempt from the usual overtime requirements, meaning they aren’t always entitled to extra pay for working more than 40 hours a week. Lawmakers might consider changing these rules.

Working hours are another concern. The FMCSA’s hours-of-service regulations limit how long commercial drivers can drive without taking required breaks and rest periods. These rules are designed to improve safety, but drivers and trucking companies sometimes disagree about how much flexibility they should have when planning their schedules.

What this means for truck drivers: The new Congress could bring more attention to driver pay, overtime protections, and working conditions. ctions that apply to their jobs.

What Does This Mean for Truck Drivers Going Into 2027?

So, let’s put everything together.

Democrats have won control of Congress, but that doesn’t mean every trucking policy will suddenly change.

President Trump will remain in office, and major legislation may require cooperation between the White House and congressional leaders.

Here are the developments I’d pay attention to over the next several months:

  1. Diesel prices and global oil supplies. Watch whether energy disruptions ease and whether that actually leads to lower fuel costs.

  2. FMCSA CDL regulations. Pay attention to any proposed changes, court decisions, or official licensing guidance.

  3. Tariffs and freight demand. Follow how changing trade policies affect the freight sectors you work in.

  4. Highway infrastructure and truck parking. Watch the next transportation funding legislation and whether new projects receive approval.

  5. Truck driver employment and operating costs. Look at real job opportunities, freight rates, fuel expenses, and compensation rather than political predictions alone.

The new Congress begins its term on January 3, 2027. That’s when the effects of the election on congressional leadership and the legislative agenda will become more apparent.

Is Truck Driving Still a Good Career Choice in 2027?

The trucking industry will continue face challenges just like any other industries. But the positive thing about trucking is that businesses across the country still rely on commercial trucks to transport food, construction materials, equipment, and everyday products. That means qualified commercial drivers continue to play an important role in the economy.
